These Terms of Use (“Terms”) govern your access to and use of FeedTalk’s web app, mobile apps, browser extension, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using FeedTalk, you represent that you meet this requirement and that you have the authority to agree to these Terms.

Your account

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Provide accurate information when you register, and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

Your content

The content you save, highlight, annotate, or otherwise add to the Service (“Your Content”) remains yours. You grant us a limited, non-exclusive license to host, store, process, and display Your Content solely to operate and improve the Service for you — including generating summaries, audio reviews, and search results. You are responsible for ensuring you have the rights to save and use Your Content, and that it does not infringe the rights of others.

Acceptable use

You agree not to:

  • Use the Service for any unlawful, harmful, or fraudulent purpose.
  • Infringe intellectual property rights or save content you do not have the right to use.
  • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its systems.
  • Use automated means to access the Service in a way that imposes an unreasonable load or circumvents usage limits.
  • Resell or redistribute the Service without our written consent.

Subscriptions and payments

Some features require a paid subscription. Prices, billing intervals, and features are shown at the point of purchase. Subscriptions purchased through the Apple App Store or Google Play are governed by those platforms’ billing and cancellation policies; subscriptions purchased on the web are processed by our payment provider. Unless stated otherwise or required by law, payments are non-refundable. Subscriptions renew automatically until canceled, and you can manage or cancel through your account or app-store settings.

Intellectual property

The Service, including its software, design, and branding, is owned by FeedTalk and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or other proprietary materials except as needed to use the Service.

Third-party content and services

The Service may let you save or access content and services provided by third parties. We are not responsible for third-party content, websites, or services, and your use of them may be subject to their own terms.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated summaries and outputs may contain errors and should not be relied upon as professional advice.

Limitation of liability

To the maximum extent permitted by law, FeedTalk and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, the provisions that by their nature should survive will continue to apply.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Additional terms for the Apple App Store

The following applies to the FeedTalk application you obtained from the Apple App Store (the “Licensed Application”). Where it conflicts with anything above, this section governs for that application.

  1. Acknowledgement. These Terms are concluded between you and FeedTalk only, and not with Apple Inc. (“Apple”). FeedTalk, not Apple, is solely responsible for the Licensed Application and its content. These Terms do not provide usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions.
  2. Scope of licence. The licence granted to you for the Licensed Application is a non-transferable licence to use it on any Apple-branded product that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that it may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
  3. Maintenance and support. FeedTalk is solely responsible for providing any maintenance and support services for the Licensed Application, as specified in these Terms or as required by applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services for it.
  4. Warranty. FeedTalk is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are FeedTalk’s sole responsibility.
  5. Product claims. FeedTalk, not Apple, is responsible for addressing any claims relating to the Licensed Application or your possession or use of it, including: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to an applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
  6. Intellectual property rights. If a third party claims that the Licensed Application, or your possession and use of it, infringes that third party’s intellectual property rights, FeedTalk, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of that claim.
  7. Legal compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or that the U.S. Government has designated as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Name and address. Questions, complaints, or claims about the Licensed Application should be directed to SHUSHUO LTD, 7 Copperfield Road, Coventry, West Midlands, England CV2 4AQ, [email protected].
  9. Third-party terms. You must comply with any applicable third-party terms of agreement when using the Licensed Application.
  10. Third-party beneficiary. You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
